1. Company Description
The Company, Authentic Shapes, focuses on retreats, coaching, workshops, and breathwork sessions within the field of personal development, in the broadest sense.

2. Definitions
Cindy de Vogel, the owner of Authentic Shapes, who uses these general terms and conditions when offering her services, is hereinafter referred to as the Contractor. The client who uses the services offered by Cindy de Vogel is hereinafter referred to as the Client. The agreement is considered all agreements made between the Client and Contractor about the services (to be) offered, both orally and in writing.
3. Terms of Payment
Authentic Shapes utilizes a Plug-and-Pay payment system.
If you feel that the retreat aligns with your needs, we will schedule an introductory call to connect with each other. Upon signing up for the retreat, a deposit of €500 is required to reserve your spot. Following your registration, you will receive an intake form via email.
The remaining balance must be paid within 30 days. Please note that retreat payments are non-refundable. However, we can provide a €500 voucher to apply toward a future retreat, subject to availability. (Deadline: [specify timeframe here])
An email with detailed information about the booked program will be sent 4 weeks prior to the retreat's start date.
Please check the confirmations carefully to ensure that all your booking details are correct. Contact us if your confirmation appears incorrect or incomplete, and we will endeavor to make the necessary changes.
In the event of late payment or default of payment, the Client shall be in default by operation of law, and the Contractor reserves the right to discontinue performance of the agreement with immediate effect. The Client shall also owe statutory interest on the outstanding amount from that time. If the Contractor assigns the claim for collection, the Client will also be liable for the judicial and extrajudicial costs involved in this collection.
4. Cancellation Policies
Due to the financial liabilities associated with hosting a retreat, workshops, and breathwork classes are non-refundable. By paying/signing up for this retreat or workshop, you acknowledge and agree to this policy.
The deposit is non-refundable, and the remaining balance is also non-refundable, even if any portion of the retreat is not attended or used.
5. Liability
5.1. The Contractor accepts no liability whatsoever, however arising, for damage caused by or in connection with services provided by it.
5.2. The Contractor is not liable for direct or indirect damages suffered by the Client as a result of actions or decisions taken as a result of or during a training, coaching session, or consultancy assignment. The Client remains at all times responsible for the choices made.
5.3. Any liability of the Contractor for trading losses or other indirect or consequential losses, of whatever nature, is expressly excluded.
5.4. The Contractor is not responsible for the personal process, progress, or outcomes experienced by the Client during or after coaching sessions, workshops, or breathwork sessions. All coaching and breathwork are meant as supportive methods, and the Client remains fully responsible for their own mental and physical well-being and for integrating any insights gained.
6. Price for Authentic Shapes Retreat
The retreat is all-inclusive except for transportation costs and 1:1 bookings of bodywork sessions.
Unless otherwise specified, not included are any applicable foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger facility charges, and international transportation tax. Tips/gratuities to staff, visa fees, baggage and personal insurance, transport to and from the airport or train station, beverages and food not listed under inclusions, and all other items of a personal nature are also not included. You should retain sufficient local currency to pay for all of the above items.
The Contractor reserves the right to amend prices at any time before payment is completed. Once the payment is made, the price is confirmed, and no surcharges will be applied unless changes are made to your arrangements after booking.
7. Circumstances Beyond Our Control (Force Majeure)
7.1. Authentic Shapes accepts no responsibility or compensation of any kind if we are constrained to make significant changes to your program or cancel your booking due to circumstances beyond our control, or if you suffer any loss or damage. Circumstances beyond our control are those that cannot be foreseen or avoided, even with due care. These include, but are not limited to, war, riots, civil disturbances, terrorist activity, industrial disputes, natural or nuclear disasters, fire, epidemics, health risks, pandemics, and severe weather conditions.
7.2. Authentic Shapes reserves the right to modify or cancel services in the event of force majeure, including but not limited to the circumstances listed above. Force majeure may also include other unforeseen events beyond our control.
8. Health and Safety
8.1. The health and safety standards that apply to the services provided under this contract should meet local standards at the booked destinations. Authentic Shapes monitors that local standards are adhered to. We are following WHO recommendations regarding COVID-19 containment.
8.2. Breathwork Participation:
a. Breathwork can result in intense physical and emotional release. It is not recommended for individuals with a history of cardiovascular disease, including angina or heart attack, high blood pressure, use of a pacemaker, glaucoma, retinal detachment, osteoporosis, significant recent physical injuries, or surgery.
b. Breathwork is not advised for individuals with mental illnesses, seizure disorders, or those using major medications. It is unsuitable for anyone with a personal or family history of aneurysms. Pregnant women are advised against practicing breathwork without consulting and receiving approval from their primary care physician. Persons with asthma should bring their inhaler and consult with both their primary care physician and the breathwork facilitator.
c. The Client agrees to comply with the stated and customary guidance and norms of participation in the activities. If you observe any unusual hazard during your participation, you will immediately remove yourself and notify the facilitator.
d. You fully understand and acknowledge that if you were not in good health, you would not be permitted to participate in the activities.
e. Pregnant or post-natal women must consult with their doctor before participating and may only join the activities with full medical approval.
f. The Client acknowledges the physical and emotional risks of breathwork and participates at their own risk. Authentic Shapes and its facilitators are not liable for any harm resulting from participation, whether or not the risks were known.
g. Breathwork is not a substitute for medical treatment. The Contractor and facilitators do not offer medical advice. Clients should consult their healthcare provider before participating, particularly if they have existing health conditions.
8.3. Special Requests and Medical Conditions:
If you have special requests or dietary requirements, you must inform us at the time of booking. We will do our best to accommodate these requests but cannot guarantee that they will be met.
8.4. Client Responsibility for Disclosing Health Conditions:
It is the Client’s responsibility to disclose any relevant health conditions prior to booking that may affect their ability to participate in the retreat, workshop, or breathwork session. Authentic Shapes reserves the right to deny participation if it is deemed that participation poses a risk to the Client’s health or safety. No refunds of any nature will be provided in the instance an activity must be canceled in consideration for your health and safety. Travel insurance is strongly recommended to cover any unforeseen health issues.
9. Online Services Disclaimer
If sessions or workshops are offered online, Authentic Shapes is not liable for technical disruptions, connection issues, or other technical limitations that impede the progress of the session. The Client is responsible for ensuring they have appropriate equipment and internet access to participate.
10. Indemnity
The Client agrees to indemnify and hold harmless Authentic Shapes and its facilitators from all claims, damages, liabilities, and expenses (including legal fees) arising from the Client’s participation in any service offered, including, but not limited to, retreats, workshops, coaching, and breathwork sessions.
11. Data Privacy
Authentic Shapes will process personal data in accordance with relevant data protection laws. Any personal data collected during the course of booking or service delivery will only be used for the purpose of fulfilling the service and will not be shared with third parties without the Client’s consent.
12. Jurisdiction
These terms and conditions are governed by the laws of the Netherlands, and any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Rotterdam.
Terms & Conditions for Portugal Retreats
By booking and participating in our retreat, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before making your reservation.
Voluntary Participation
Taking part in the retreat is completely voluntary. Any practice or exercise offered is a suggestion. It is your own free choice and responsibility to participate or not. Cindy de Vogel or any co-facilitator will not be liable for processes that will require professional attention after the retreat.
Booking and Payment
Payment will be done through the Plug and Pay payment system. To secure your booking, a non-refundable deposit of 500 euro is to be made at the time of reservation. As this fee is non-refundable, make sure you are fully committed when signing up.
The remaining payment must be paid 30 days after paying the deposit. This remaining balance of the retreat price is non-refundable.
Cancellation and Refunds
No money will be refunded, also not for any portion of the retreat not attended or used.

Changes to the Retreat
Cindy de Vogel reserves the right to make any necessary changes to the retreat program, schedule, or accommodation. You will be notified as soon as possible of any significant changes.
Circumstances Beyond Our Control (Force Majeure)
In the unlikely event that Cindy de Vogel needs to cancel the retreat, you will be offered a full refund, including the deposit, or the option to transfer the deposit to a future retreat.
Exception to this is when there are circumstances beyond Cindy de Vogel’s control. No responsibility or compensation of any kind can be taken where Cindy de Vogel is constrained to make a significant change to your program or cancel your booking due to circumstances beyond Cindy de Vogel’s control. Participants’ Responsibility / Health & Safety
In order to take proper care of safety during the retreat, you are responsible to provide Cindy de Vogel with any relevant information on the state of your physical, emotional, and mental health. This also includes any medical conditions, dietary requirements, or special needs prior to the retreat. We will do our best to accommodate requests and needs but cannot guarantee that they will be met.
You are also responsible for ensuring you have adequate travel insurance to cover the retreat and any associated risks or unforeseen health issues.
In case of important information lacking, Cindy de Vogel and co-facilitators can NOT be held liable for any unwanted consequences that participation in the retreat has on the participant.
Cindy de Vogel reserves the right to refuse participation of a participant in any retreat activity if it is deemed that participation would pose a risk to the participant's health or safety. No refund of any nature will be provided in this instance, and activity must be canceled in consideration for your health and safety.
Liability
Cindy de Vogel or any co-facilitator is not responsible for any loss, damage, or injury sustained by participants during the retreat, including but not limited to loss of personal belongings, personal injury, or health issues.
Participants agree to indemnify and hold harmless, its instructors, and staff from any claims, demands, or actions arising out of or in connection with their participation in the retreat.
Audio/Video Recordings
In general, mobile or electronic devices are not allowed inside any of the ceremonial spaces. Under no circumstance will video recording by participants be allowed during the sessions. In some cases, we will allow audio recording for personal use, but ONLY when given consent upfront from Cindy de Vogel.
During the retreat, there will be some moments that photos and videos will be taken for promotional purposes by Cindy de Vogel or co-facilitators. By agreeing with these terms & conditions, you also agree that these photos and videos may be used on the website and/or social media.
Privacy
Cindy de Vogel respects your privacy and is committed to protecting your personal information. Your details will not be shared with any third party without your consent, except as required by law.
By providing your personal information, you consent to its use in accordance with the Privacy Policy.
Governing Law
These terms and conditions are governed by and constructed in accordance with the laws of Dutch rights, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the Netherlands.
Agreement
By booking and participating in a retreat organized by Cindy de Vogel, you agree to abide by these terms and conditions.
